A judge does not have to accept the recommendation of the prosecution, even if it was agreed upon by the victim, defendant, and everyone else. It is a rarity for a judge to not go along with a prosecutions recommendation, and I find it appalling that the judge in this case chose to give a minor, with no record, a much longer sentence than was agreed upon to plea on. I hope the rally on Jul,y 16th does some good. I also hope that an appeal is accepted and this travesty is overturned.
